TEST DRIVE AGREEMENT & LIABILITY WAIVER By signing this form, the undersigned ("Customer") acknowledges and agrees to the following terms and conditions:

1. ELIGIBILITY. Customer represents and warrants that they (a) hold a valid, unexpired driver's license issued by a U.S. state or territory, (b) are legally authorized to operate a motor vehicle in the State of Texas, and (c) currently maintain valid automobile liability insurance that meets or exceeds the minimum coverage requirements mandated by the State of Texas.

2. ASSUMPTION OF RISK. Customer acknowledges that operating a motor vehicle involves inherent risks, including the risk of property damage, personal injury, or death. Customer voluntarily assumes all such risks arising from or related to the test drive, to the fullest extent permitted by applicable law.

3. LIABILITY & INDEMNIFICATION. Customer agrees to be solely responsible for, and shall indemnify, defend, and hold harmless Cheema Auto & Collision Center, its owners, employees, agents, and representatives from and against any and all claims, damages, losses, fines, penalties, and expenses (including reasonable attorney's fees) arising out of or resulting from: (a) any traffic citations, violations, or infractions incurred during the test drive; (b) any collision, accident, or damage to the test drive vehicle or any third-party vehicle or property caused by Customer's operation; or (c) any personal injury to Customer, dealership personnel, or any third party occurring during the test drive.

4. VEHICLE CONDITION. Customer agrees to return the vehicle in the same condition as received, reasonable wear excepted. Customer acknowledges that any damage caused during the test drive is their financial responsibility and authorizes Cheema Auto & Collision Center to document and assess such damage upon return of the vehicle.

5. ROUTE & CONDUCT. Customer agrees to operate the vehicle in a safe and lawful manner, to obey all applicable traffic laws, and to remain within the designated test drive route as directed by dealership personnel. Reckless, negligent, or unlawful operation of the vehicle is strictly prohibited.

6. INSURANCE COVERAGE. Customer's personal automobile insurance is considered primary in the event of any accident or loss during the test drive. Customer understands that the dealership's insurance policy may not cover damages caused by an uninsured or underinsured driver, and that Customer may be held personally liable for the full cost of any such damages.

7. PERSONAL INFORMATION. Customer consents to the collection and verification of their driver's license and personal information for the purpose of facilitating the test drive and for dealership records, in accordance with applicable privacy laws.

8. GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising out of or related to this Agreement shall be resolved exclusively in the state or federal courts located in Harris County, Texas.

By signing below, Customer acknowledges that they have read, understood, and voluntarily agree to all terms of this Test Drive Agreement & Liability Waiver. Customer further acknowledges that no oral representations have been made that alter or supersede the terms herein.
